Terms of Use

These Terms of Use (“Terms”) are a legal agreement between you and Time Lapse Technologies LLC (“we,” “us,” or “our”) governing your access to and use of the Super Clocker application and related services (the “Service”). By creating an account, signing in, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account or using the Service in any way, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. Your continued use of the Service after any changes to these Terms constitutes acceptance of the revised Terms.

2. Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must not use the Service to violate any applicable law, infringe others’ rights, or transmit harmful or illegal content.

3. Pricing and Free Use

We currently plan to offer the Service free of charge for the foreseeable future. We have no present plans to introduce paid plans or paid features. We reserve the right to add paid features or paid plans in the future; if we do, we will communicate any changes in advance where appropriate.

4. “AS IS” and “AS AVAILABLE”

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and title. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. You use the Service at your own risk.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TIME LAPSE TECHNOLOGIES LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, OR GOODWILL) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us, if any, in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater. Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

5. No Professional Advice

The Service is for personal time-tracking and productivity purposes only. It does not constitute legal, financial, tax, or other professional advice. You are solely responsible for decisions you make based on your use of the Service.

7. Modifications and Availability

We may modify, suspend, or discontinue the Service or any part of it at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation. We may also update these Terms; the “Last updated” date will reflect the most recent version. Your continued use after changes constitutes acceptance.

8. Indemnification

You agree to indemnify, defend, and hold harmless Time Lapse Technologies LLC and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any third-party rights.

9. Dispute Resolution and Governing Law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law principles. Any dispute arising from these Terms or the Service shall be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts. Nothing in these Terms limits your right to seek relief in a small-claims court where applicable.

10. General

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect. Our failure to enforce any right or provision does not waive that right or provision. These Terms constitute the entire agreement between you and Time Lapse Technologies LLC regarding the Service and supersede any prior agreements. We may assign our rights and obligations under these Terms; you may not assign without our prior written consent.
